El proyecto de Reforma del Código Penal que ha presentado el ministro Gallardón contempla la expulsión de los extranjeros en situación regular condenados por delitos menos graves.
El artículo 88 del proyecto establece que “las penas de prisión de más de un año impuestas a un ciudadano extranjero serán sustituidas por su expulsión del territorio español”.

Esta punibilidad extraordinaria por razón de nacionalidad, puede llevar a la situación de que un nacional y un extranjero regular, que hayan participado y sido condenados por la comisión de un mismo delito, obtengan un resultado tan diferenciado como es la puesta en libertad del español (por suspensión de la pena de prisión) y la expulsión, con prohibición de entrada de hasta 10 años y extinción de su autorización de residencia, del inmigrante.
Se prevé la posibilidad de que cumpla parte de la pena y después se proceda a la expulsión, por lo que la persona extranjera está sometida en este caso a una doble penalidad, pues una vez cumplida la parte de pena que se le ha impuesto discrecionalmente (que puede ser la totalidad si es superior a cinco años de prisión), se ejecutará una “segunda pena” en forma de expulsión y prohibición de entrada. Se renuncia además, a la reinserción social de la persona que delinque, que es constitucionalmente la finalidad del código penal según nuestra constitución.
Por último frustra los procesos de Integración, en cuanto considera expulsables casi a un 12% de la población, nos presenta a los inmigrantes como un cuerpo ajeno a nuestra sociedad, prescindible cuando no son instrumentalmente necesarios. Desprecia el grado de incrustación de esta población en nuestra sociedad, su aportación a la misma y el grado de esfuerzo que éstos realizan para conseguir su inserción social. La expulsión de extranjeros residentes por las mismas penas por las que un nacional sería puesto en libertad, además de profundamente injusta, tiene terribles consecuencias sobre estos procesos de integración, no sólo de la persona directamente afectada, sino también de sus familias.
